What Type of Temporary Work Visa Do I Need?
There are several categories of temporary work visas for the U.S. It is important to apply for the correct one.
The types of work visas available in the United States are:
- H visa: Temporary workers or trainees - Most common: H-1B visa.
- L visa: Transfers within a company - Most common: L-1 Visa.
- O visa: Persons with extraordinary ability
- P visa: Entertainers, artists, athletes
- Q visa: International cultural exchange
- R visa: Religious worker
Who Qualifies for an H-1B Visa?
In order to qualify for an H1B, the individual must have a U.S. bachelor’s degree or an equivalent of it in the field that they will be hired for. If a license is a mandatory requirement for the position, the prospective employee must also have it.
Aside from the individual’s qualifications, the circumstances for the open position must be a certain way. The U.S. employer must be able to prove that foreign workers are needed and that the work cannot be done by U.S. citizens because they are either not available or not qualified.
Temporary Religious Worker
Since this could end up being a very broad route of access for many people into the United States, there have been clear stipulations placed on what qualifies as a temporary religious worker.
A temporary religious worker must:
- Work an average minimum of 20 hours per week
- Work as a minister or in a religious occupation or vocation in the U.S.
- Be employed by a nonprofit religious organization in the U.S.
- Be a member of the denomination of the organization for whom you plan to work, for a minimum of 2 years prior to the organization filing a petition on your behalf
L-Visas
An L visa is a non-immigrant visa that allows multinational companies to transfer employees from their foreign operations to their U.S. operations for temporary periods. There are two types of L visas: L-1A visas for executives and managers, and L-1B visas for employees with specialized knowledge.
To qualify for an L visa, the following requirements must be met:

Employer-Employee Relationship: The U.S. employer must have a qualifying relationship with a foreign company, such as a parent company, branch, subsidiary, or affiliate.

Executive or Managerial Capacity: To qualify for an L-1A visa, the employee must be employed in an executive or managerial capacity, which involves managing a major function or department of the company.

Job Offer in the U.S.: The U.S. employer must offer the employee a job in the U.S. in the same or similar capacity as their foreign employment.

Duration of Stay: The L visa is initially granted for up to three years for new U.S. companies and up to five years for existing U.S. companies. Extensions may be granted for a total stay of up to seven years for L-1A visa holders, and up to five years for L-1B visa holders.

Intent to Depart the U.S.: The employee must intend to depart the U.S. when their L visa expires.

Qualifying Relationship: Foreign and U.S. companies must have a qualifying relationship, such as a parent-subsidiary, branch office, or affiliate relationship.
